1. Agreeing to these Terms
These Terms of Service (“Terms”) are an agreement between you and Archbro (“Archbro,” “we,” “us,” or “our”). They govern your access to and use of Archbro, including the website at archbro.app and its subdomains, the Archbro web application, its WebMCP Site Tools, APIs and related services (together, the “Services”).
By creating an account, checking the box to accept these Terms, or using the Services, you agree to these Terms and acknowledge our Privacy Policy, which explains how we handle personal information. If you do not agree, do not use the Services.
If you use the Services on behalf of a company or other organization, you represent that you have authority to accept these Terms on its behalf, and “you” includes that organization.
2. Who can use Archbro
You must be at least 18 years old and able to form a binding contract to use the Services. You may not use the Services if you are barred from doing so under applicable law, or if we have previously suspended or terminated your account.
3. Beta service and pricing
The Services are currently offered as a free beta. During the beta:
- Features, limits and availability may change, be suspended or be discontinued at any time, with or without notice.
- The Services may contain bugs, may be unavailable from time to time, and may lose or corrupt data. Keep your own copies of anything important, such as the source code in your repositories.
- We may set usage limits to keep the Services available and fair for everyone.
We plan to introduce paid plans in the future. We will not charge you without first telling you about the price and terms and getting your agreement. Paid plans may be subject to additional terms that we will present to you before you subscribe.
4. Your account
You can sign up with an email address and password or through a supported sign-in provider such as Google or GitHub. You agree to give accurate information, keep it up to date, and keep your login credentials secure. You are responsible for activity that happens under your account. Tell us promptly at hello@magicdala.com if you believe your account has been compromised.
Accounts are for individual people. Do not share your account or create accounts by automated means.
When you first sign in, we may ask you a few optional questions to set up your account, such as your role, what you want to do first and how you heard about Archbro. We use your answers to tailor the Services to you as described in our Privacy Policy. Your answers are not Your Content as defined in Section 5.
5. Your content
What counts as your content
“Your Content” means the material you or your agents submit to the Services, such as project goals, prompts, notes, tasks, architecture decisions, comments, review decisions and material retrieved from repositories or other sources you connect (“Inputs”), and the material the Services generate for you in response, such as architecture maps, summaries, recommendations and answers (“Outputs”).
Ownership
As between you and Archbro, you retain all rights you have in your Inputs, and, to the extent permitted by law, we assign to you any rights we may have in the Outputs. Outputs may not be unique, and other users may receive similar Outputs.
The permission you give us
You grant Archbro a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit and display Your Content only as needed to provide, secure, maintain and support the Services for you and the people you choose to share with, and to comply with law. This license ends when Your Content is deleted from the Services, except for copies we must keep for legal reasons or that remain temporarily in backups.
No training on your content
We do not use Your Content to train artificial intelligence or machine learning models, and we do not permit our AI provider to do so. If we ever want to change this, we will ask for your permission first.
Your responsibilities
You are responsible for Your Content. You represent that you have all rights and permissions needed to submit it, including for any repositories, documents or workspaces you connect, and that your use of the Services does not violate the law, any agreement you are bound by (such as an employer’s confidentiality policy), or anyone else’s rights.
6. AI features and outputs
Archbro uses artificial intelligence, currently Google’s Gemini models provided through Google Cloud Vertex AI, to analyze projects and generate Outputs. AI is probabilistic and can produce Outputs that are inaccurate, incomplete, outdated or inappropriate, including descriptions of your code or architecture that look plausible but are wrong.
- Evaluate Outputs, including any architecture recommendation or task, before you rely on or act on them. Archbro is designed so that material architecture changes go through human review; you are responsible for the decisions you accept.
- Outputs are not professional advice (for example legal, security, safety or engineering certification advice) and do not replace qualified human review.
- Do not represent that Outputs were written by a human when they were not.
We may change the AI models and providers we use. If a change materially affects how we handle your personal information, we will update our Privacy Policy.
7. Connectors, agents and third parties
The Services let you connect third-party services such as GitHub, Slack, Google Drive and Microsoft Teams (“Connectors”), and let a coding or AI agent you choose interact with your projects through WebMCP Site Tools (“Your Agent”).
- When you authorize a Connector, you allow Archbro to access the data that Connector makes available, within the permissions you grant, to provide the Services. You can disconnect a Connector at any time in Archbro, and you can also revoke access in the third-party service.
- Your Agent is operated by you or by a third party you choose, not by Archbro. Information Your Agent reads through Archbro is handled under that agent provider’s terms and privacy practices. You are responsible for the actions Your Agent takes in Archbro on your behalf.
- Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services, their availability, or how they handle your data.
8. Sharing and collaboration
You can invite other people to view or edit your projects. People you share with can see, and depending on their role change, the shared project and its content. You are responsible for choosing whom you share with and for removing access that is no longer appropriate. If someone shares a project with you, respect the owner’s rights in it.
9. Acceptable use
You agree not to, and not to help or allow others to:
- use the Services in violation of any law or regulation, or to infringe, misappropriate or violate anyone’s intellectual property, privacy or other rights;
- upload or connect content you do not have the right to use, or content that contains malware or other harmful code;
- use the Services to develop malware, attack systems, or harm, harass, defraud or exploit anyone;
- probe, scan or test the vulnerability of the Services, or bypass any security, authentication, rate limit or usage limit, except with our prior written permission;
- interfere with or disrupt the Services, servers or networks, or place an unreasonable load on our infrastructure;
- access the Services by automated means other than the interfaces we provide (such as WebMCP Site Tools and documented APIs), or scrape data from the Services;
- reverse engineer, decompile or attempt to extract the source code or underlying models of the Services, except to the extent the law expressly allows it despite this restriction;
- resell, sublicense or provide the Services to others as a service bureau, or use the Services or Outputs to build a competing product;
- use Outputs to develop or train AI models that compete with the Services; or
- misrepresent your identity or your affiliation with any person or organization.
You must also follow the usage policies of the AI and Connector providers whose services Archbro uses on your behalf.
10. Our intellectual property
Archbro and its licensors own all rights in the Services, including the software, design, Site Tools, documentation and the Archbro name and logo. Except for the limited right to use the Services under these Terms, these Terms do not grant you any rights in them. You may not use our names, logos or trademarks without our prior written permission.
11. Feedback
We welcome ideas, bug reports and suggestions (“Feedback”). If you give us Feedback, you allow us to use it for any purpose without restriction or compensation to you. This does not give us any additional rights in Your Content.
12. Suspension and termination
You may stop using the Services at any time. To close your account and delete its data, email hello@magicdala.com from the address associated with your account.
We may suspend or terminate your access to all or part of the Services if we reasonably believe you have violated these Terms, if needed to protect the Services, other users or third parties, if required by law, or if we discontinue the Services or the beta. Where reasonable, we will give you notice and an opportunity to export Your Content before termination.
Sections 5 (ownership and responsibilities), 10, 11, 13, 14, 15 and 17, and any other terms that by their nature should survive, survive termination.
13. Disclaimers
THE SERVICES, INCLUDING ALL OUTPUTS, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” ESPECIALLY DURING THE BETA. TO THE FULLEST EXTENT PERMITTED BY LAW, ARCHBRO DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT OUTPUTS WILL BE ACCURATE OR RELIABLE, OR THAT ANY CONTENT WILL BE PRESERVED WITHOUT LOSS.
Some jurisdictions do not allow certain warranties to be disclaimed, so some of these disclaimers may not apply to you.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER ARCHBRO NOR ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY AND (B) ONE HUNDRED U.S. DOLLARS (US $100).
These limitations apply to any theory of liability and even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
15. Indemnity
To the extent permitted by law, you will defend, indemnify and hold harmless Archbro and its affiliates, officers, employees and agents from and against any third-party claims, liabilities, damages, losses and expenses (including reasonable attorneys’ fees) arising out of or relating to Your Content, your use of the Services, or your violation of these Terms or of anyone else’s rights.
16. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes to the Services, the introduction of paid plans, or legal requirements. We will update the date at the top of this page. If a change is material, we will give you reasonable advance notice, such as through the Services or by email, and where required we will ask you to accept the updated Terms. Changes will not apply retroactively. If you do not agree to the updated Terms, stop using the Services.
17. General
- Entire agreement. These Terms, together with the Privacy Policy and any additional terms you agree to for specific features or paid plans, are the entire agreement between you and Archbro about the Services.
- Severability. If any part of these Terms is found unenforceable, it will be enforced to the maximum extent possible, and the rest will remain in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, reorganization or sale of assets, or to an affiliate.
- No third-party beneficiaries. These Terms do not create rights for anyone other than you and Archbro.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
- Notices. We may send you notices through the Services or to the email address associated with your account. You can send notices to us at hello@magicdala.com.
